Terms and Conditions of Sale and Use

1. Seller Information

The website Everlux (hereinafter “Site”) is owned by:

2. Scope of Application

These General Conditions govern:

  • access to and use of the Site;
  • the purchase of products offered on the Site by consumers (individuals acting for purposes unrelated to business or professional activity) and professionals.

By placing an order, the user fully accepts these Conditions.

3. Registration and Use of the Site

Registration on the Site is not mandatory to make a purchase but allows faster processing of future orders.
The user agrees to provide accurate data and not to use another person’s identity.
The seller is not responsible for misuse of credentials by third parties.

4. Pre-contractual Information

In accordance with Articles 49 et seq. of the Consumer Code, the customer declares that they have read, before purchase:

  • the main characteristics of the products;
  • the identity of the seller (details above);
  • the total price including taxes and shipping costs;
  • the payment and delivery methods;
  • the conditions, terms, and exclusions of the right of withdrawal;
  • the duration of the legal warranty of conformity.

5. Products and Availability

Products are described in the relevant product sheets. Images are indicative and may slightly differ from the actual product.
Availability is indicated but not guaranteed: in case of an unavailable product, the seller will promptly inform the customer and issue a refund.

6. Prices and Payment Methods

All prices are expressed in Euros and include VAT, unless otherwise indicated.
Accepted payment methods are:

  • Credit/debit card
  • Satispay

The contract is considered concluded at the time of order confirmation by the seller, after verification of payment.

7. Shipping and Delivery

Deliveries are made via express courier throughout Italy.
Average delivery time: 2-7 business days from payment confirmation.
Shipping costs are calculated and shown to the customer during the order process.

The risk of loss or damage passes to the customer upon delivery.

8. Right of Withdrawal

Pursuant to Articles 52 et seq. of the Consumer Code, the consumer customer has the right to withdraw within 14 days of receiving the goods, without providing reasons.

To exercise the right of withdrawal, the customer must send a written communication to info@everlux.it.
The goods must be returned intact, unused, and complete with original packaging.
Return costs are borne by the customer.
The refund (including standard delivery costs) will be made within 14 days of receiving the returned goods.

The right of withdrawal does not apply to:

  • custom-made or clearly personalized goods;
  • sealed products that cannot be returned for hygiene reasons once opened after delivery.

9. Legal Warranty of Conformity

Pursuant to Articles 128-135 of the Consumer Code, products purchased by consumers are covered by a 24-month legal warranty.
For professional customers (with VAT number), the warranty is 12 months.

Any defects must be reported within 2 months of discovery, via email to info@everlux.it.
In case of defect, the customer has the right to restore conformity through repair or replacement at no cost.

10. Limitation of Liability

The seller is not responsible for damages resulting from improper use of the products or non-compliant installations.
It is the customer’s responsibility to verify product compatibility with their system.

11. Privacy and Cookies

Personal data is processed in compliance with EU Regulation 2016/679 (GDPR).

12. Governing Law and Jurisdiction

The contract is governed by Italian law.
For disputes with consumers, the court of the place of residence or domicile of the customer has jurisdiction.
For dealings with professionals, the Court of Vicenza has exclusive jurisdiction.
